We hereby ask you to get acquanted to the terms and conditions of the mobile application and in case, there are some terms unacceptable for you, we kindly ask you to terminate the usage of the application immediately.

Each and every form given in the mobile application , including but not limited to, screen, contact to the company, information about service and the service itself are performed solely within the framework of private usage and it shall not be connected in any way with  the commerce, business or professional work.

We remind you that you will be liable for any illegal use of the mobile application.

Definitions:

In case there are no other remarks in the text, terms mentioned below have the following definitions:

• Mobile Application / application – Mobile application owned by the company ,    where you register, include the relevant information, get access and get the relevant service from the company;
• Customer /user/ you – physical person registered in the mobile application which receives the service via having the access from the products placed on the application;
• Legislation / law – Legislation of Georgia; laws of Georgia
• Cookies – Automatic system for data collecting

About us:

,,Forma’’ is the mobile application aiming to provide the services related to the healthy lifestyle. The application offers different types of diet programs for users to select and purchase whichever they prefer, as well as access to various services available on the platform.

Intellectual Property

Each section, form, photo, communication, video, document, drawing, figure, logo, menu, page, graphic, color, plan, tool, rule, function, and software (Hereinafter - Data) presented in the Application represents the sole property of the Company and/or its related third-party and is protected by the relevant intellectual property law of Georgia.

It is not permitted to publish, distribute, or otherwise process/distribute Data contained in the application without the prior written consent from the Company.

Registration

A user’s profile can be created in the application either through registration or Facebook authentication. (For more information on the privacy policy, please refer to the relevant section) (1) During registration, the user is required to provide name, phone number, and body measurments (age, weight, height). Alternatively (2) during Facebook authentication, the application will have an access to the user's registered data on facebook, such as email address, first and last name.

Once the user's profile has been registered, personal  account will be activated in the mobile application.

Terms of the Agreement

1. Once the user's account is activated, he/she will be given an access to various services offered by the application, including the blog, training courses, the calories calculator and other paid services.
2. Based on the user's data and information (answers to questions), the application automatically generates the best food plan for the user. The user is then given the opportunity to purchase the food plan of her/his choice.
3. Upon purchasing the food plan, the user will be given access to additional services, including a mentor's assistance and access to the communities

Payment

1. The service fee will be paid by the customer's credit/debit card, after completing the relevant payment procedure.
2. Within the payment process, the company will not use your financial information (credit card number, expiration date, etc.) for any purpose other than to fulfill the order, requesting refunds or reporting fraud to the police. The service fee, as indicated on the order form, will be charged to your current bank account upon order confirmation.

Communication

1. To contact the company user can use the form in the mobile application, contact information, including, telephone, e-mail and registered address.
2. For communications with the user company can use the form in the mobile application and the contact information provided by the user to the company or placed in his/her profile

Declarations and warranties

User declares that:

• is capable at the moment of receiving the service (in accordance with the legislation of Georgia)
• The information provided during registration, as well as on other stages,  including contact details, is complete and accurate.
• Registration was carried out by her/his personal desire, without any influence and/or coercion from third parties.
• He/she is informed about the terms of the company’s personal data processing and privacy policy, confirms and acknowlidges it (details can be found here).
• Any violation of the company’s policy will result in an immediate disqualification of the user.
• User acknowlidges and agrees that the company may use his/her contact information from time to time to provide offers, including advertising information. In order to do so company reserves the right to process the user’s personal information to the extent permitted by the Georgian Leegslation.

Limiting liability

If the user does not achieve the desired result during or after using the company's paid services, the company shall be exempt from any responsibility. To avoid any misunderstanding, this exclusion of liability does not apply to assistance provided for the full and continuous use of the purchased service, including access to groups and mentoring.
 

Updates

The mobile application shall be updated from time to time. If new products or services are added and/or any other changes are made, the user will receive relevant updates. user knows and acknowlidges that without receiving updates, the application may work with interruptions.

Saving the information

After canceling or deactivating user’s account, we may retain your contact information for a reasonable period of time for backup, archive, commercial, or audit purposes, to the extent permitted by law. However, you can request to have your contact information removed from our platform at any time.

All electronic messages (SMS, e-mail, forms placed on the platform, etc.) sent by the company or to the company are automatically saved by the system in a special electronic journal system that has the power of legal evidence. The company protects them using reasonable technical and appropriate organizational measures. Access to these messages is only allowed in certain cases and by authorized persons in strict compliance with applicable laws and regulations, such as the legal compliance or risk department.

• When requesting assistance (technical and any other type) we may need information to provide the assistance you require.

Any changes will be immediately published in the appropriate section of the Application and will be binding upon publishing. While we do our best to ensure accuracy, we makes no representation or warranty regarding the information contained in the recipes or the accuracy thereof, and there can be no assurance that any of the information contained therein has not been, or will not be changed or altered.
